TERMS OF SERVICE

These Terms govern your use of archivedsouls.com and any purchase you make from us. By using the site or placing an order, you agree to them. If you do not agree, do not use the site.

1. Who we are

Archived Souls LLC is a limited liability company organized in the Commonwealth of Virginia.

2. Eligibility

You must be at least 18, or have the permission of a parent or legal guardian, to place an order. By ordering, you confirm that the payment method you are using belongs to you or that you are authorized to use it.

3. Products and limited runs

Our pieces are released in limited quantities. When a size or style sells out, it may not return.

All quantities are finite and stated at release. When we say a run is 100 units, it is 100 units.
Every piece is sold in stock and in hand. We do not take pre-orders or sell against inventory we do not physically have.
Our garments are washed and finished by hand-applied processes. Colour, fade placement, distressing, and print texture vary from piece to piece. Product photography shows one representative unit, and your piece will not be identical to it. This variation is the product, not a flaw. See the Return and Refund Policy for the difference between variation and a defect.
Measurements are listed flat and carry a manufacturing tolerance of ±0.5 inches.
Screen colour rendering varies by device. We cannot guarantee that the colour on your screen matches the garment in person.

4. Orders, pricing, and acceptance

Your order is an offer, not a completed sale. A confirmation email means we received your order — it does not mean we have accepted it. The sale is complete when we ship.

We may cancel or refuse any order, in whole or in part, including when:

The item is out of stock or the run has sold out
There is an error in the listed price or description
We suspect fraud, a chargeback risk, or unauthorized use of a payment method
The order breaks a stated purchase limit
We cannot ship to the address given

If we cancel your order after charging you, we will refund you in full to the original payment method.

Pricing. Prices are in U.S. dollars and do not include shipping or tax. We may change prices at any time before an order is placed. We are not obligated to honour an obvious pricing error.

Purchase limits. We may limit quantities per person, household, or payment method during a release, and we may cancel orders that appear to exceed those limits.

Sales tax. We collect Virginia retail sales and use tax where required, and any other state or local tax we are obligated to collect. Tax is calculated at checkout based on your shipping address.

Payment. Payments are processed by Stripe through Shopify. We do not receive or store your full card number.

5. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Return and Refund Policy. Both are incorporated into these Terms by reference. Read them before ordering — our releases are final sale, with a limited exception for manufacturing defects.

6. Content you submit to us

If you send us a photo, a written answer to one of our questions, a review, a message, or any other content ("Submission"), you grant Archived Souls LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, adapt, publish, and display that Submission in connection with the brand — including on our website, on social media, in printed materials, and on cards or inserts included with our products.

You keep ownership of your Submission. You are simply giving us permission to use it.

You confirm that:

The Submission is yours, or you have the right to give us this permission
It does not infringe anyone's rights or contain anything unlawful
You are not entitled to payment for its use

We publish community answers anonymously. We do not attach names, handles, or identifying details to answers we share or print. If you want your Submission removed, email contact@archivedsouls.com and we will stop using it going forward. We cannot recall materials already printed and shipped.

Do not send us anything you would not want published. Do not send us confidential information, and do not send us unsolicited product or design ideas — if you do, we are free to use them without obligation to you.

7. Our intellectual property

The Archived Souls name, the interconnected "AS" monogram, the "ARCHIVED" wordmark, the phrase "Formed, not performed," the interior lining artwork, our garment designs, photography, films, written content, and site design are owned by Archived Souls LLC and protected by intellectual property law.

You may not reproduce, copy, manufacture, or create derivative works from them without our written permission. You may share our published content on social media in its original form, with attribution.

Buying a garment gives you the garment. It does not give you a licence to our designs or marks.

8. Acceptable use

Do not:

Use bots, scripts, or automated tools to browse, monitor, or purchase from the store
Buy with the intent to resell in a way that breaks a stated purchase limit
Interfere with, probe, or attempt to breach the site or its security
Scrape, copy, or republish site content at scale
Impersonate another person or use someone else's payment method
Use the site for anything unlawful

We may refuse service, cancel orders, and block access to anyone who does these things.

9. Third-party services

Our store runs on Shopify, takes payment through Stripe, and ships through third-party carriers. Those services have their own terms and policies, and we are not responsible for how they operate. Links to third-party sites are provided for convenience and are not endorsements.

10. Disclaimer of warranties

Except as expressly stated in our Return and Refund Policy, the site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or secure, or that product descriptions are free of errors.

Nothing here limits any rights you have under applicable consumer protection law that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, Archived Souls LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the site or any product purchased from us.

Our total liability for any claim will not exceed the amount you paid for the product giving rise to that claim.

12. Indemnification

You agree to indemnify and hold harmless Archived Souls LLC from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.

Before filing anything, email us at contact@archivedsouls.com. Most problems are solvable in one message, and we would rather solve it than litigate it.

14. Changes to these Terms

We may update these Terms at any time. The version in effect when you place an order is the version that governs that order. Continuing to use the site after an update means you accept the new Terms.

15. General

If any provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, Shipping Policy, and Return and Refund Policy, are the entire agreement between us.
